Psilocybin mushrooms, also known as “magic mushrooms,” are currently illegal in Canada. Possession, production, and distribution of psilocybin mushrooms are criminal offenses under the Controlled Drugs and Substances Act. However, in August 2020, the Canadian Federal Court approved medical access to psilocybin under certain conditions and the Federal government has initiated a process to decriminalize possession of small amount of psilocybin. It’s also worth noting that the legal status of psilocybin mushrooms is subject to change, as there have been ongoing discussions and efforts to decriminalize or legalize them for medicinal and therapeutic use.
